Apple was recently awarded damages of $1.05 billion when it won its patent case against Samsung in the US, although according to a recent report Apple is seeking higher damages from Samsung.
According to the Korea Times, Apple’s legal team will be asking US Federal Judge Lucy Koh to increase the damages from the original $1 billion that Apple were awarded in the trial.
Apple are apparently seeking damages from Samsung in the region of $3 billion US dollars, which is three times what they were originally awarded by the court.
The finding of what legal officials say is “willful infringement’’ enables Apple to seek triple the damages awarded.
“By using that condition, Apple has decided to request the judge to order Samsung to pay more than $3 billion in the hearing on the San Jose verdict on Sept. 21 in California,’’ one senior legal executive, who asked to be quoted as a “reliable source.’’
The Basis for Seeking Higher Damages
The basis for Apple’s request for higher damages lies in the concept of “willful infringement.” In patent law, willful infringement occurs when a party knowingly violates a patent with full awareness of its actions. This is considered a more severe offense compared to unintentional infringement, and it allows the plaintiff to seek up to three times the amount of the original damages awarded. Apple argues that Samsung’s infringement was willful, thus justifying their request for $3 billion in damages.
Apple’s legal team is leveraging this aspect of patent law to argue that the initial $1.05 billion awarded is insufficient given the scale and impact of Samsung’s infringement. The additional damages would serve not only as compensation but also as a deterrent against future violations by Samsung or other companies.
Implications for the Tech Industry
The outcome of this case could have far-reaching implications for the tech industry. If the court decides to increase the damages to $3 billion, it would set a precedent for future patent infringement cases. Companies would need to be more cautious about ensuring their products do not infringe on existing patents, as the financial repercussions could be significantly higher.
Moreover, this case highlights the intense competition and legal battles between major tech giants like Apple and Samsung. Both companies have a history of litigation against each other, and this case is one of the most high-profile examples. The decision could influence how these companies approach innovation and intellectual property in the future.
Whether or not the court will decide to increase the damages that Samsung has to pay Apple remains to be seen. The hearing on the San Jose verdict is scheduled for September 21 in California, and it will be closely watched by legal experts, industry analysts, and tech enthusiasts alike.
