Apple and Samsung are battling it out in various courts around the world, the latest patent trial between the two companies is taking place in Australia and now Apple has said that the 3G it is using in its devices is not Samsung’s 3G.
According to Apple, because of the way it is implementing the 3G on its devices it does not infringe on Samsung’s patent, Samsung holds a patent for the 3G standard.
Apple have said that when Samsung claimed that Apple are infringing on their 3G patent, Samsung did not check to see how Apple are implementing the 3G.
“We make the submission that this is an unusual case of infringement, because our friends have not done a process one might normally expect,” he said. “The allegations of infringement assume in some circumstances that, where the words of the standard leave open [to interpretation] that, necessarily, the option nominated by Samsung [has been chosen and] infringement has taken place.”
It will be interesting to see what the outcome of this trial is, as it could have a bearing on the various other court cases between Apple and Samsung.
