A while back Apple was granted an injunction against Samsung on the Galaxy Tab 10.1 tablet being imported and sold in Germany, Samsung has been appealing the decision, and it the latest court case Apple’s injunction has been upheld.
This is bad news for Samsung who have been attempting to get the injunction over turned, and now it looks like Samsung has exhausted its options with the Düsseldorf Regional Court, and will have to take its case to the high court in Germany.
Florian Mueller from Foss Patents points out that it could take Samsung a while to get this ruling over turned.
The preliminary injunction stays in force until it is either overturned by the Higher Regional Court in a fast-track appeals proceeding or by the (lower) Regional Court at the end of the full-blown main proceeding, which would probably take about a year.
