The dispute between Lodsys and iOS and Android devlopers seems to be heating up, as the company has responded to Apple’s recent statement, where Apple announced that they were responsible for the in App purchases on iOS apps and not the individual developers.
Lodsys have announced on their website that they do not agree with Apple’s statement regarding the license of their patents for in app purchases, and it looks like they are still taking legal action against the individual developers.
We stand firm and restate our previous position that it is the 3rd party Developers that are responsible for the infringement of Lodsys’ patents and they are responsible for securing the rights for their applications. Developers relying on Apple’s letter do so to their own detriment and are strongly urged to review Apple’s own developer agreements to determine the true extent of Apple’s responsibilities to them.
From the companies recent statement, it seems that Lodsys has been in communication with Apple over the in app purchases, and they are claiming that the agreement between themselves and Apple does not cover individual developers.
So are Lodsys attempting to come to some new agreement with Apple over in app purchases? And are they using legal action against indivdual developers as a way to leverage a new deal with Apple?
Of course we have also heard that Lodsys are going after Android developers as well, and we have yet to receive any official word from Google on this. Take a look and our article on Android vs iPhone to see which smartphone and mobile platform is best for you.
