Not only that, what happens to the accounts that were banned, do they get a refund? No they don't, that to me is the same as stealing, and thats what the lawsuit needs to take into consideration, the fact that xbox live accounts are being banned, not because of piracy, which is in their statement, but because of the modification of the system, further proof of that fact is the very way they look to ban xbox live accounts. look at it this way, 1 million users banned, zero refunds, roughly $50 000 000 in pocket, plus the sale of xbox's required to replace the banned xbox, plus buying a new xbox live account, this adds up to well over 100 000 000. The issue here is with a multi billion dollar industry, possibly more, dictating to us what the law is. And all as they had to do to pull it off was to update their xbox live terms of use contract. something needs to be done about this, not just because of the subject, but the concept of this move is fucking dangerous.

Yes piracy is illegal, but modding an xbox 360 is not, but microsoft is banning modded consoles because they are modded, not because they are playing pirated games, this should never have happened, banning an xbox account because they are playing on a pirated version of a game is one thing, because yeah, thats piracy, but playing on a modded console with a retail version of the game, thats not illegal, now i dont know if microsoft just couldn’t tell if people are playing pirated games or it was just easier to do it the way they did.
